A prenuptial agreement is a private contract, entered into before a couple gets married. A postnuptial agreement is a private contract, entered into after a couple gets married. Both a prenuptial agreement and postnuptial agreement is executed to settle the couple’s financial division, including asset and debt allocation, in the event of a divorce or separate maintenance action. On some occasions, an individual may not be ready to file for divorce, is still interested in trying to help the marriage, by attending couples counseling, but still wants some sort of financial protection. The law in Georgia is that marital assets and debts continue to accrue up to the entry of a Final Judgment and Decree of Divorce. However, a postnuptial agreement can allow a couple to work on their marriage, without having to worry about protecting their assets. This allows the couple to focus on the marriage, not the divorce.
