Third Party Custody

There are times when a parent isn’t capable of caring for a child. In some situations, a parent voluntarily concedes custody to a third party. In other situations, litigation is required to show unfitness of a parent.

The Equitable Caregiver Act in Georgia, enacted in July 2019, allows individuals who are not a child's biological or adoptive parent to petition for custody or visitation rights if they have taken on a full and permanent parental role in a child's life, providing consistent care and establishing a strong bond, and whose parental role is acknowledged and accepted by the child's parent(s).
