Legitimation & Paternity
Many of our clients did not know that as a father, if you have a child outside of a marriage, you have no legal rights in Georgia, until there is a Court order legitimating the child. Mothers of children who are born outside of a marriage, are able to file paternity actions, seeking child support from the biological father. Pursuant to Georgia law, a child’s legitimate parent has a duty to support the child. In some situations, there is a possibility of seeking support for the time prior to the entry of a court order, for payment of a child’s expenses.
Many individuals wait until the relationship ends, or parenting time is no longer agreed upon, to legitimate a child. There are many unexpected consequences that can arise as a result of the delay. If any of these issues relate to you, please contact us to learn more.
